Smartbooth Alert Tools End User License Agreement

1. Products Covered
This license agreement covers the following Smartbooth software products:
- GPUAlert
- CPUAlert
- PingAlert
- PortAlert
These products help users monitor GPU utilization, GPU memory (VRAM), temperature, power and hardware health, CPU and host memory usage, host availability, and TCP port availability, depending on the product. They send alert and recovery notifications through supported channels. Available monitoring features depend on the product, operating system, hardware, and drivers.
2. License Grant
Smartbooth grants you a limited, non-exclusive, non-transferable license to download, install, and use the software according to the license type you purchased or the trial terms provided with the software.
3. Trial Use
The software may include trial-mode limitations. Trial mode is provided for evaluation only. Trial limitations may include limits on alert volume, monitored targets, notification channels, or other product functions.
Trial limits vary by product and version. Refer to the documentation supplied with your software for the applicable limits. A valid paid license removes the applicable trial restrictions; product capacity limits and third-party service charges still apply.
4. Paid License
A paid license allows use of the software according to the product and license terms purchased. A license may be tied to device or system information. You may not share, resell, publish, or distribute your license file or license key.
GPUAlert is licensed separately and is not included in CPUAlert, PingAlert, or PortAlert bundles or site plans. A GPUAlert Node License covers one authorized Linux operating-system instance and all supported GPUs in that instance, and remains valid for the purchased major version. GPUAlert Site Licenses are annual and subject to the host allowance and scope of the purchased plan. 5. Restrictions
You may not:
- Reverse engineer, decompile, disassemble, modify, or create derivative works of the software except where allowed by law.
- Remove copyright, license, or ownership notices.
- Redistribute the software as part of another commercial product without written permission from Smartbooth.
- Use the software in a way that violates applicable laws or third-party rights.
- Bypass, tamper with, or disable license verification or trial limitations.
6. Ownership
The software is licensed, not sold. Smartbooth retains all rights, title, and interest in the software, including intellectual property rights.
7. Updates
Smartbooth may provide updates, fixes, or new versions. Updates may be subject to the same license agreement unless accompanied by separate terms.
8. Alerts and Third-Party Services
Depending on the product and version, the software may send notifications through email, Smartbooth SMS, Telegram, Microsoft Teams, Slack, Discord, LINE, webhooks, PagerDuty, or other supported services. You are responsible for configuring these services correctly and complying with their terms of use. SMS credits and other service or delivery charges are separate from the software license. Smartbooth is not responsible for delivery failures caused by third-party services, network problems, incorrect configuration, or service outages.
9. No Warranty
The software is provided “as is” without warranties of any kind, whether express or implied. Smartbooth does not guarantee that the software will be error-free, uninterrupted, or suitable for every environment.
10. Limitation of Liability
To the maximum extent permitted by law, Smartbooth shall not be liable for indirect, incidental, special, consequential, or business interruption damages, including loss of data, loss of revenue, or missed alerts.
11. User Responsibility
You are responsible for testing the software in your own environment, confirming alert delivery, protecting your configuration files, and maintaining proper backup or monitoring procedures.
GPUAlert health reports reflect only the telemetry available from the GPU, driver, and operating system. A healthy status means no fault was detected in that available telemetry; it is not a complete hardware self-test or a guarantee that every GPU fault will be detected.
12. Termination
This license terminates automatically if you violate its terms. Upon termination, you must stop using the software and delete all copies under your control.
