Smartbooth Alert Tools End User License Agreement

This End User License Agreement applies to Smartbooth CPUAlert, PingAlert, and PortAlert, including Windows and Linux versions where applicable.

1. Products Covered

This license agreement covers the following Smartbooth software products:

These products are lightweight monitoring utilities designed to help users monitor CPU usage, memory usage, host availability, and TCP port availability, and to send alert notifications through supported channels.

2. License Grant

Smartbooth grants you a limited, non-exclusive, non-transferable license to download, install, and use the software according to the license type you purchased or the trial terms provided with the software.

3. Trial Use

The software may include trial-mode limitations. Trial mode is provided for evaluation only. Trial limitations may include limits on alert volume, monitored targets, notification channels, or other product functions.

4. Paid License

A paid license allows use of the software according to the product and license terms purchased. A license may be tied to device or system information. You may not share, resell, publish, or distribute your license file or license key.

The software is licensed, not sold. Smartbooth retains all rights, title, and interest in the software, including intellectual property rights.

Smartbooth may provide updates, fixes, or new versions. Updates may be subject to the same license agreement unless accompanied by separate terms.

8. Alerts and Third-Party Services

The software may send notifications through email, Telegram, Microsoft Teams, or other supported services. You are responsible for configuring these services correctly and complying with their terms of use. Smartbooth is not responsible for delivery failures caused by third-party services, network problems, incorrect configuration, or service outages.

9. No Warranty

The software is provided “as is” without warranties of any kind, whether express or implied. Smartbooth does not guarantee that the software will be error-free, uninterrupted, or suitable for every environment.

10. Limitation of Liability

To the maximum extent permitted by law, Smartbooth shall not be liable for indirect, incidental, special, consequential, or business interruption damages, including loss of data, loss of revenue, or missed alerts.

11. User Responsibility

You are responsible for testing the software in your own environment, confirming alert delivery, protecting your configuration files, and maintaining proper backup or monitoring procedures.

12. Termination

This license terminates automatically if you violate its terms. Upon termination, you must stop using the software and delete all copies under your control.
